WizeSwap Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of WizeSwap. By creating an account or using WizeSwap, you agree to these Terms.
1. WizeSwap's Role
WizeSwap provides tools that allow users to schedule local meetups, verify attendance, and provide feedback concerning meetup reliability.
WizeSwap is not a marketplace and is not a party to transactions between buyers and sellers.
WizeSwap does not own, inspect, sell, purchase, deliver, authenticate, or guarantee items offered through third-party marketplaces or by WizeSwap users.
2. Eligibility
You must be at least 18 years old and legally capable of entering into these Terms to use WizeSwap.
You agree to provide accurate information and to maintain the security of your account.
3. Phone Verification and SMS
Certain WizeSwap features may require phone verification.
By providing your mobile phone number and requesting verification, you consent to receive transactional SMS messages from WizeSwap containing one-time verification codes.
Message frequency varies. Message and data rates may apply.
SMS messages used for phone verification are transactional and are not marketing or promotional messages.
You are responsible for providing a mobile number that you are authorized to use.
WizeSwap may use third-party providers, including Twilio, to deliver verification messages.
4. Meeting Requests
Either a buyer or seller may initiate the WizeSwap meeting process using a WizeSwap Meeting Link.
Users may be required to verify their phone number before submitting or accepting a meeting request.
A meetup becomes confirmed only after the applicable participants have completed WizeSwap's required confirmation process.
5. Attendance Verification
WizeSwap may allow users to verify their presence at or near an agreed meetup location using their device's location services.
Location verification indicates only that WizeSwap received location information consistent with the user's device being within the applicable verification area and time period. It does not guarantee the user's identity, safety, conduct, intentions, or completion of a transaction.
Users remain responsible for determining whether, where, and with whom they choose to meet.
6. Feedback
WizeSwap may allow users to provide feedback concerning scheduled meetups.
Feedback eligibility and available feedback options may depend on meeting status, attendance verification, cancellation, rescheduling, lateness, and other information recorded by WizeSwap.
Users agree not to submit false, misleading, defamatory, threatening, harassing, or otherwise unlawful feedback.
WizeSwap may remove or restrict feedback when reasonably necessary to enforce these Terms or protect the service and its users.
7. Marketplace Transactions
WizeSwap may be used in connection with third-party services such as Facebook Marketplace, Craigslist, OfferUp, or other classified marketplaces.
WizeSwap is independent of these services unless expressly stated otherwise. References to third-party marketplaces do not imply sponsorship, endorsement, partnership, or affiliation.
Any purchase, sale, exchange, payment, item condition, delivery, dispute, or other transaction is solely between the applicable buyer and seller.
8. Meetup Safety
Meeting another person involves inherent risks.
You are responsible for exercising appropriate judgment and precautions when arranging or attending a meetup. WizeSwap's verification, scheduling, location, and feedback features are intended to provide additional information and accountability but do not guarantee that another user is trustworthy or that a meetup will be safe or successful.
9. Prohibited Conduct
You may not use WizeSwap to:
Impersonate another person;
Provide knowingly false account or meeting information;
Manipulate attendance verification or feedback;
Harass, threaten, stalk, or harm another person;
Facilitate unlawful transactions or activities;
Attempt to circumvent account or phone-verification requirements;
Interfere with WizeSwap's systems or security; or
Use WizeSwap in violation of applicable law.
We may suspend or terminate accounts that violate these Terms.
10. No Guarantee of Attendance or Transactions
WizeSwap is designed to encourage accountability, but we do not guarantee that any user will attend a scheduled meetup, arrive on time, complete a transaction, act appropriately, or provide accurate information.
Past attendance or feedback does not guarantee future behavior.
11. Disclaimer of Warranties
To the extent permitted by law, WizeSwap is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
12. Limitation of Liability
To the fullest extent permitted by applicable law, WizeSwap and its owners, operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of WizeSwap or interactions or transactions with other users.
Nothing in these Terms excludes liability that cannot legally be excluded.
13. Account Suspension and Termination
We may restrict, suspend, or terminate access to WizeSwap when reasonably necessary to protect users, prevent fraud or abuse, comply with law, or enforce these Terms.
14. Changes to These Terms
We may update these Terms periodically. Continued use of WizeSwap after updated Terms become effective constitutes acceptance of the updated Terms where permitted by law.
